Nephew Pleads Guilty In Frying Pan Assault

DOTHAN, Ala.—A Dothan man pleaded guilty Tuesday to beating his uncle, who is wheelchair-bound, with a frying pan during a robbery.

Circuit Court Judge Lawson Little sentenced James Lamarcus Jackson, 45, of Young America Drive, to serve 20 years in prison for felony second-degree assault. Jackson pleaded guilty Tuesday to the felony assault, which had been reduced from first-degree robbery as part of the plea.

“On Dec. 27, 2007, James Lamarcus Jackson struck his uncle in the arms, hands and face with a frying pan,“ Assistant District Attorney Nereida Bundy said.

Bundy also told the court that Jackson stole his uncle’s wallet, which had about $60 inside, along with some loose change. She said the indictment returned against Jackson alleged he used a frying pan and/or baseball bat during the robbery.

Bundy said Jackson’s uncle suffered a fractured jaw and nose, along with some cuts and bruises that required stitches, during the assault.

“The victim was cooking sausage, and he was struck in the back of the head with what he thought was a frying pan,“ Bundy said.

Dothan police investigators arrested Jackson on Dec. 28, 2007, and charged him with felony first-degree robbery.

Bundy said Jackson’s uncle, who attended the hearing at the Houston County Courthouse, agreed to the plea, and said he did not want his nephew to spend the rest of his life in prison. She said Jackson faced 15 to 99 years or life in prison for the assault, because he had three prior felony convictions.

Bundy said the 20-year sentence will run concurrently with another 15-year sentence he received for a felony receiving stolen property case. Jackson’s probation was revoked on the receiving stolen property charge in April 2008, because of the new robbery charge.

He had been serving the 15-year prison sentence for that crime at the time of his guilty plea on Tuesday.
