COLUMBUS, Ohio -- Ohio State University wants to dismiss a lawsuit that alleges a former employee was forced to resign over his handling of racist letters mailed to students in 2007.

The university is asking U.S. District Court Judge John Holschuh to throw out the lawsuit filed by Steven Kremer, the university's former director of campus housing.

The university made its request Friday.

Kremer says he was punished for not delaying the delivery of the batch of racist letters, which he says would have violated federal law.

Kremer also says the university pushed him out because he raised questions about how the university was awarding building contracts.

Ohio State says Kremer hasn't provided evidence that his rights to free speech and due process were violated.
