DAYTON, Ohio -- A judge has ordered a second psychological exam for a Columbus man accused of killing a Dayton-area woman and leaving her 4-year-old son at a highway rest stop.
The first exam concluded that Charlie Myers is competent to stand trial. Defense attorneys say that exam was unreliable in determining whether Myers' hearing impairment and language deficit will affect his ability to understand the proceedings.
Judge Dennis Langer of Montgomery County Common Pleas Court says he was showing discretion when he ordered a second exam Monday.
The 22-year-old Myers has pleaded not guilty to aggravated murder.
Prosecutors say he shot the 29-year-old woman on Jan. 2 and had sexual contact with the boy. They plan to seek the death penalty.
