Police Charge Ohio Dad In Son's Death

HAMILTON, Ohio -- Police say a southwest Ohio father has been charged with negligent homicide after his 5-year-old boy fatally shot himself. Hamilton city police spokesman Rich Burkhardt says 35-year-old David Nesbitt is expected to turn himself in to face the first-degree misdemeanor count. A phone number for Nesbitt couldn't be found Friday.

Authorities said Zachariah Nesbitt found a handgun in the family's apartment and shot himself in the chest July 18. Police say Nesbitt had a concealed carry permit for the gun, but it was left loaded in a closet. Burkhardt says the case will go to municipal court. He says Nesbitt has no criminal record, and would face a maximum sentence of six months in jail if convicted.
