CINCINNATI, Ohio -- An attorney for pet owners who accused an Ohio-based pet store chain of selling sick puppies says he will file an amended lawsuit with more specific allegations. The original lawsuit against Petland Inc., filed in March, was dismissed Friday by a federal judge in Phoenix who said the allegations were too general and that the suit did not show that the plaintiffs were direct victims of the alleged fraud.
Attorney Simon Paris said Monday pet owners have until Aug. 29 to file an amended complaint. Some of the owners are members of the Humane Society of the United States. Petland, based in Chillicothe, Ohio, has denied the claims and says it is pleased with the dismissal. A message was left at Hunte Corp., a Missouri-based company named in the lawsuit, which also has denied the claims.
