CINCINNATI, Ohio
A federal appeals court panel has refused to delay the Ohio execution of a multi-state killer who is scheduled to be executed Tuesday.
An attorney for John Fautenberry had gone to the 6th U.S. Circuit Court of Appeals on Monday after a lower court rejected his second plea to force the state pay for a neuropsychological examination. Fautenberry's last mental exam was 13 years ago.
The former Oregon truck driver was sentenced to die by lethal injection for murdering a Cincinnati-area man who gave him a ride in February 1991. He has also been linked to deaths in Alaska, New Jersey and Oregon.
Messages seeking comment were left for his attorney, Dennis Sipe.
