Mother Of Abandoned Infant Won't Face Charges

DELAWARE, Ohio — No criminal charges were to be filed against a mother who abandoned her baby boy at the Lewis Center Meijer in June 2009.

NBC 4 reported with information from our media partner The Delaware Gazette.

The Delaware County sheriff’s office positively identified the mother of the newborn baby who was found abandoned June 9 late last month.

The office referred the case to the city prosecutor to determine what, if any, charges the woman would face.

City prosecutor Peter Ruffing called the case a “unique situation."

“I have reviewed the applicable laws and tried to determine not only the letter of them, but also their spirit and intent. Based on these considerations, it is my recommendation that no criminal charges be filed in the case,” Ruffing wrote in a memorandum to Sheriff Walter L. Davis III Monday.

Authorities were not releasing the mother's name as she wasn't charged with a crime.

The abandoned child, whom the county named Thomas Benjamin Lewis, has been in foster care since shortly after he was found by a passing motorist.
