WAVERLY, Ohio -- The Pike County man who avoided charges of kidnapping and assaulting his estranged wife because of a prosecutor's paperwork error could still spend a year in prison after a judge ruled a trial will move forward on a weapon charge.
Michael Hall faced up to 19 years in prison before Pike County Common Pleas Judge Randy Deering dismissed eight charges against him Thursday. Pike County Prosecutor Robert Junk listed the wrong date of Hall's arrest on his indictment. That led to the scheduling of Hall's trial on November 17, more than 90 days past Hall's arrest and jailing on August 3. That violated Hall's right to a speedy trial in Ohio.
Hall's attorney, Robert Rosenberger, argued a ninth charge for possession a weapon in a school safety zone should have been dismissed as well because while the charge was added in September, it was based on evidence from August 3.
Deering disagreed and ruled Friday that the weapon charge will go to trial. Michael Hall now faces a maximum of 12 months in prison, if convicted.
Shelley Hall is the victim in the case. She said she was kidnapped on the morning of August 3 by her estranged husband, Michael Hall. Shelley Hall said she was held for more than three hours and beaten to the point that she needed 20 stitches and had a concussion for weeks.
