HAMILTON, Ohio -- Legal experts say the case against twin brother pediatricians accused of molesting some of their patients is particularly challenging for the judge and jury.
Dr. Mark Blankenburg went on trial Monday in Hamilton, Ohio, on 41 charges involving sex, drugs and bribery. His brother, Dr. Scott Blankenburg, goes on trial in April on 22 charges that are similar but do not include drug counts. Both have pleaded not guilty.
In the current case, the jury will determine 16 sex charges against Mark Blankenburg, while the judge determines guilt or innocence on 25 other charges. Legal analysts say the complexity of the case sets up issues for possible appeal if the doctor is convicted. Martin Pinalesoi, a former president of the National Association of Criminal Defense Lawyers, says he's never seen such a split.
