COLUMBUS, Ohio -- The state is reviewing whether dozens of felons sent back to prison for parole violations might have to be released because of problems with their original sentences.
The Ohio Department of Rehabilitation and Correction has identified 208 inmates who may be affected and says there could be more. At issue are inmates subject to parole - known as mandatory supervision in Ohio.
Inmates who might be released received sentencing orders that didn't make it clear the supervision was mandatory. The Ohio Supreme Court ruled June 9 the Ohio Parole Board can't enforce mandatory supervision if the supervision isn't explicitly spelled out in a sentencing order.
The inmates were sent back to prison for violations such as failing a drug test.
