COLUMBUS, Ohio -- The Ohio Supreme Court's disciplinary board is recommending that a Cleveland judge be punished for threatening to jail a defendant in an assault case if the victim didn't show up to testify.
But the board on Wednesday also recommended that the one-year suspension be stayed, allowing Cuyahoga County Common Pleas Judge Daniel Gaul to keep working.
The case now goes to before the full Supreme Court for a final decision.
Gaul threatened to jail the defendant because he feared that the victim had been intimidated to not testify against her attackers.
The disciplinary board said Gaul's threat violated the state's Code of Judicial Conduct and Rules of Professional Conduct.
Gaul has said that he was trying to prevent witness intimidation.
